Terms & Conditions
1.1 The ‘Anticipated Account’ is the statement of estimated cost for the provision of services from 81 Events for an Event.
1.2 The company, firm or person to whom the proposal and Anticipated Account of 81 Events is addressed is referred to as ‘the Client’
1.3 Any persons or companies who provide products or services in respect of Events are referred to as ‘Suppliers’
1.4 Confirmation of a booking with 81 Events, whether made verbally or in writing by or on behalf of a client is referred to as ‘the Confirmation’.
1.5 Any function, occasion or other event for which the services of 81 Events are engaged or expected to be engaged under these Terms and Conditions is referred to as the/an ‘Event’.
1.6 ‘Agreement’ means the contract between 81 Events and the Client to which these Terms and Conditions apply.
2.1 The Terms and Conditions set out herein represent the entire basis of the agreement between 81 Events and the Client.
2.2 The Agreement shall be construed and interpreted in accordance with English Law and the parties involved agree to submit the jurisdiction of the English Courts in respect of any dispute.
2.3 In the event that any of the Terms contained within the Terms and Conditions of 81 Events are set aside by an English Court the client acknowledges and agrees that the remaining Terms shall stand as if the Terms set aside had never constituted part of the original Terms and Conditions.
2.4 81 Events reserve the right to amend or waive any or all of these Terms and Conditions for special bookings. Any such amendment or waiver will be notified to the Client in writing.
2.5 No variation or alteration to these Terms and Conditions shall be valid unless approved by 81 Events in writing.
3.1 81 Events reserve the right to require Confirmation in writing but shall be authorised to proceed with booking upon verbal Confirmation by the Client based upon the Terms and Conditions set out herein.
3.2 Confirmation of booking the services of 81 Events either verbally or in writing will constitute acceptance of the latest Anticipated Account and these Terms and Conditions.
3.3 81 Events reserve the right to revise the Anticipated Account in the event of a material change to either the number of guests and/or the latest Anticipated Account than that originally confirmed. A material change would be construed as a change, equal to or greater than, 10% of the number of notified guests and/or the latest Anticipated Account.
3.4 All items offered are subject to availability.
4.1 Due to advanced purchasing requirements 81 Events require the final number of guests expected to attend the Event to be notified 14 days prior to the date of the Event.
4.2 After this notification 81 Events will endeavour to accommodate any reasonable increases. Any decreases in the quantity will be charged at the full charge.
5 PAYMENT TERMS
5.1 Upon confirmation of an Event a proforma invoice for 50% of the latest Anticipated Account will be submitted to the Client and is payable upon receipt. In the event that payment is not received in accordance to these Terms prior to the Event, 81 Events reserve the right to terminate this Agreement without further notice.
5.2 Where satisfactory credit references are not obtained 81 Events reserve the right, at it’s discretion, to refuse credit terms to the Client.
5.3 If 81 Events, in its absolute discretion, waives the above Terms relating to payment of deposits at prescribed dates prior to the Event, such waiver shall not prejudice the rights of 81 Events to recover from the Client the amounts which otherwise would have been payable under these Terms and Conditions in the event of a cancellation or amendment of an event.
5.4 The amounts paid upon Confirmation will be deducted from the final invoice.
5.5 The balance of the account is due 14 days after the receipt of the final invoice.
5.6 Any queries arising from an invoice must be communicated in writing to 81 Events within 5 working days of receipt. Payment Terms set out above apply notwithstanding query.
5.7 On accounts that have exceeded these Payment Terms 81 events reserve the right to charge interest equivalent to 4% per month above the base rate of the HSBC Bank plc.
6.1 Once an Event has been Confirmed 81 Events reserve staff, time and ancillary items and may refuse to cater for other Events that wish to book the services of 81 Events. Therefore charges are payable for any cancellation of a Confirmed Event.
6.2 Any cancellation made by the Client must be notified to 81 Events in writing. Date of receipt of this notice will determine the cancellation charge applicable.
6.3 81 events reserve the right to charge up to 25% of the most recent Anticipated Account for cancelled Events to compensate for costs incurred and loss of profits. However, should the cancellation be received within 28 days prior to the Event 81 Events reserve the right to charge up to 50% of the most recent Anticipated Account, or 75% if the cancellation is received within 14 days prior to the Event.
7 LOSS AND DAMAGE
7.1 Any loss or damage to equipment or property will be the responsibility of the Client and the replacement cost will be charged in full.
7.2 81 Events does not accept responsibility for the personal property of Clients or Guests. Goods left with 81 Events are left at the owner’s risk and without any liability for loss or damage howsoever caused on the part of 81 Events.
8.1 The liability of 81 Events for a supplier’s failure to perform or to provide services or otherwise is limited to the value of that supplier’s services.
8.2 In any event 81 Events has no liability for any failure to provide any services due to industrial action, postal or other communicational delay, plant failure, hostilities, or any other circumstances beyond the control of 81 Events.
8.3 The Client shall indemnify and keep indemnified 81 Events against any costs or liabilities incurred by 81 Events as a result of any breach of these Terms by the Client.
